To the fullest extent permitted by law,Deco Gear and Beach Camera Inc. shall not be liable for any indirect,incidental,special,or consequential damages arising from your purchase or use of any product. Our total liability shall not exceed the purchase price of the product giving rise to the claim. Some states do not allow limitation of liability for consequential damages,so this limitation may not apply to you.

Deco Gear shall not be liable for any delay or failure to perform any obligation where such delay or failure results from circumstances beyond our reasonable control,including but not limited to acts of God,natural disasters,pandemic,epidemic,fire,flood,earthquake,war,terrorism,government action,labor disputes,supply chain disruptions,carrier failures,or internet outages. In such events,our obligations will be suspended for the duration of the disruption.

Any dispute,claim,or controversy arising out of or relating to your purchase or any product must be resolved as follows:(1) You agree to first contact Deco Gear at support@decogear.com to attempt informal resolution within 30 days of the dispute arising. (2) If informal resolution fails,the dispute must be submitted to non-binding mediation in the State of New Jersey before any legal proceeding may be initiated. (3) If mediation does not resolve the dispute within 60 days,the dispute shall be finally and exclusively resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules,conducted in the State of New Jersey. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. YOU AND DECO GEAR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. All disputes are governed by the laws of the State of New Jersey,without regard to conflict of law provisions.
